Guac Mexi Grill – charges


Three face historic charges under Saskatchewan’s Foreign Worker Recruitment and Immigration Services Act, marking the first prosecution of its kind in the province. Kartikkumar Prakashkumar Patel, Rutvik Hasmukhbhai Patel, and Piyushkumar Mafatbhai Patel each face three counts related to violations at Guac Mexi Grill in Moose Jaw between August 2023 and February 2024.

All three have been charged with:

  • Taking action against, or threatening to take action against, a foreign worker for participating in an investigation or proceeding by any government or law enforcement agency, or for making a complaint to such an agency.
  • Taking unfair advantage of a foreign national’s trust, or exploiting a foreign national’s fear or lack of experience or knowledge.
  • As an employer, charging a foreign worker a fee or expense for employment.

The accused are scheduled to appear in Moose Jaw Provincial Court on Nov. 25.

Under the older legislation, employers could be penalized up to $50,000 for an individual, $100,000 for a business, and face up to one year in jail. Under the Immigration Services Act, penalties went up to $750,000 for an individual, $1.25 million for a business, and up to two years in jail.
